Florida Air Construction and Operation Permits for Stationary Sources (Chapter 62-210)

A commercial or industrial project that adds an emergency generator, a boiler, a spray booth, or a concrete batch plant can trigger an air permit before the equipment is ever installed. WHAT FDEP AIR PERMITTING COVERS

The Florida Department of Environmental Protection's Division of Air Resource Management regulates stationary sources of air pollution under Chapters 62-210, 62-212, and 62-213, F.A.C. Any facility or emissions unit that emits, or can reasonably be expected to emit, an air pollutant must obtain the appropriate authorization before the activity unless it is exempt.

THE AIR CONSTRUCTION PERMIT

Under Rule 62-210.300, an air construction permit must be obtained before beginning construction, reconstruction, or modification of a facility or emissions unit, or before adding air pollution control equipment. The permit is issued for a period long enough to construct the source and to operate while demonstrating initial compliance through testing.

AIR OPERATION PERMITS: TITLE V VS. NON-TITLE V

After construction, an air operation permit is generally required. Major sources obtain a Title V operating permit on the long-form application, which the U.S. Environmental Protection Agency reviews and which requires public notice. Minor and synthetic-minor sources obtain a non-Title V permit; a Federally Enforceable State Operating Permit is published, while ordinary minor-source permits are not.

AIR GENERAL PERMITS

Rule 62-210.310 offers air general permits for eligible lower-emission categories — among them concrete batch plants, certain dry cleaners, printing operations, and stationary internal combustion engines such as generators. An owner registers through the Air General Permit Electronic Registry System with the applicable fee, generally at least 30 days before construction or operation.

EXEMPTIONS AND MINOR SOURCES

Rule 62-210.300(3) and Rule 62-4.040 establish exemptions based on industrial category, operating conditions, and generic emission thresholds. A facility can also accept federally enforceable limits to qualify as a synthetic-minor source, keeping its potential emissions below major-source thresholds and outside the Title V program.

DELEGATED LOCAL PROGRAMS

FDEP delegates air permitting to local programs in much of the state. In the tri-county region, county environmental agencies administer many sources, and in Palm Beach County the county health department issues operating licenses under an air agreement. The applicable local program reviews the source alongside the state framework.

COUNTY AND MUNICIPALITY INSPECTION COMMENTS FOR PERMIT APPROVAL

Common comments include:

  • Emission equipment installed before the air construction permit was issued.

  • Source operating without the required operation permit.

  • Air general permit not registered before the equipment was placed in service.

  • Exemption claimed without demonstrating the threshold or category.

  • Emissions unit modified beyond the terms of the existing permit.
