WHICH FOOD ESTABLISHMENTS THE HEALTH DEPARTMENT REGULATES
The Department of Health works with food service establishments that include institutions, schools, civic or fraternal organizations, bars and lounges, theaters that serve traditional theater foods, and locations participating in the USDA Afterschool Meal Program. These establishments are governed by Chapter 64E-11, Florida Administrative Code, and Section 381.0072, Florida Statutes, and align with the 2013 FDA Food Code.
THREE AGENCIES, THREE JURISDICTIONS
Three Florida agencies share food-safety oversight, and identifying the right one is the first step:
Department of Agriculture and Consumer Services — grocery stores, food processing plants, food storage, and distribution.
Department of Business and Professional Regulation — restaurants, mobile food vehicles, and caterers.
Department of Health — institutions, schools, civic and fraternal organizations, bars and lounges, theaters, and USDA Afterschool Meal sites.
THE 90-DAY PLAN REVIEW REQUIREMENT
To apply for a sanitation certificate and open a Department of Health-regulated food service establishment, the plan review packet must be provided and completed 90 days in advance of construction or modification and before opening. Submitting early prevents the most common cause of opening delays.
WHAT YOUR PLAN REVIEW PACKET MUST INCLUDE
A complete packet generally includes:
Application for plan review (Form DH8003).
Two complete sets of plans, including site plans and floor plans of the entire facility; the food service area must also show equipment, plumbing, electrical service, and mechanical ventilation.
Utility sign-off for water and sewage.
Equipment schedules.
Plan review fee.
Application for Sanitation Certificate (Form DH4086) with the permit fee.
SANITATION CERTIFICATE AND OPENING INSPECTION
Sanitation certificates are issued by the local county health department where the facility is located. When construction is complete and all kitchen equipment is installed and fully operational, the opening inspection is scheduled. A valid sanitation certificate is required prior to opening. Approval of the plan and issuance of the certificate satisfy state requirements but do not relieve the owner of county, municipal, or other permit obligations.
WATER, SEWAGE, AND UTILITY SIGN-OFFS
If the property is served by an onsite sewage system or a private well, a completed evaluation of capacity must accompany the application. Where water and sewer are utility-provided, written approval or proof of service is required. Temporary food service events are handled separately under Form DH8004.
COUNTY AND MUNICIPALITY INSPECTION COMMENTS FOR PERMIT APPROVAL
Plan reviewers commonly return the following before approving a food establishment:
Plans not drawn to scale or food-service area equipment, plumbing, electrical, and mechanical ventilation not labeled.
Three-compartment sink, handwash stations, or mop/utility sink locations missing or insufficient.
Water supply and wastewater approvals (utility or capacity evaluation) not enclosed.
Finish schedules for floors, walls, and ceilings in food-prep and warewashing areas not specified as smooth, durable, and cleanable.
Certified Food Manager and sanitation certificate not in place prior to the opening inspection.
