Properties relying on a private well, irrigation well, or monitoring well in South Florida need a construction permit before drilling, repairing, modifying, or abandoning the well. Although the underlying rule is a state environmental rule, the permit itself is typically issued at the county level. WHAT THE DRINKING WATER WELL PROGRAM COVERS

The program covers the construction, repair, modification, and abandonment of drinking water supply wells, along with irrigation and monitoring wells. The construction of drinking water supply wells is regulated by Chapter 62-532, Florida Administrative Code, adopted by the Florida Department of Environmental Protection, which holds overall authority under Section 373.309, Florida Statutes.

WHO ISSUES WELL PERMITS IN SOUTH FLORIDA

The rule is normally implemented by Florida's five water management districts, several of which have delegated the permitting program to county health departments. Miami-Dade, Broward, and Palm Beach are among the delegated counties. In these counties, the Florida Department of Health issues well construction permits, performs field inspections, and initiates enforcement for private wells.

WELLS THAT REQUIRE A DEPARTMENT OF HEALTH PERMIT

In delegated counties, all water wells 12 inches in diameter or smaller, including irrigation and monitoring wells, require a Department of Health permit prior to well construction, abandonment, repair, or modification. Larger-diameter and certain regulated-area wells may fall under the water management district directly.

THE WATER MANAGEMENT DISTRICT WATER USE PERMIT PREREQUISITE

A well construction permit will not be issued until the required water management district water use permit has been obtained. In South Florida that district is generally the South Florida Water Management District. Plan for this prerequisite early, because the well permit cannot advance without it.

LICENSED WELL DRILLERS AND THE PERMIT SEQUENCE

Wells must be installed by a well driller licensed through one of the Department of Environmental Protection's water management districts. The typical sequence is:

  1. Obtain the water management district water use permit.

  2. Apply for the well construction permit through the delegated county health department.

  3. Drill with a licensed contractor and disinfect the well to inactivate any microbiological contamination introduced during construction.

  4. Complete the well final inspection and obtain the completion report.

LIMITED USE PUBLIC WATER SYSTEMS (CHAPTER 64E-8)

Small community or commercial water systems that serve fewer than 25 people are regulated directly by the Department of Health as Limited Use Public Water Systems under Chapter 64E-8, Florida Administrative Code. These require a construction approval to confirm the rule's safeguards are met, followed by an annual operating permit once construction is complete.

COUNTY AND MUNICIPALITY INSPECTION COMMENTS FOR PERMIT APPROVAL
