Tattoo & Body Art Establishment Build-Out Standards Under Florida Administrative Code 64E-28

A tattoo or body art studio is a regulated environmental-health establishment, and its finishes, sinks, lighting, and separation from any living space are written into state rule. THE LAW BEHIND TATTOO ESTABLISHMENTS

The Practice of Tattooing is governed by Sections 381.00771 through 381.00791, Florida Statutes, and Chapter 64E-28, Florida Administrative Code, effective September 5, 2012. The county health department where the establishment is physically located administers licensure and inspection.

ESTABLISHMENT LICENSE AND INSPECTION

A tattoo establishment license is required before tattooing. The application is Form DH 4151, the license is valid for one year, and it is not transferable from one location or person to another. Establishments must pass inspection, recorded on Form DH 4153, for compliance with the statute and rule. In Miami-Dade County the establishment license fee is $200.

CONSTRUCTION AND FINISH STANDARDS (RULE 64E-28.007)

Under Rule 64E-28.007, a tattoo establishment must have walls, a floor, and a ceiling, and the floor and walls in the tattooing area must be constructed of non-absorbent, easily cleanable materials. The entire establishment must be maintained in clean condition and good repair. These finish requirements drive material selections that belong in the construction documents.

SEPARATION FROM LIVING QUARTERS

There must not be a direct opening between a tattoo establishment and any portion of a building used as living or sleeping quarters. This separation must be accomplished by a solid floor-to-ceiling wall. Home-based operations are also typically restricted by local zoning for commercial use.

HANDSINKS, LIGHTING, WATER, AND SEWAGE

Operational and design requirements include:

  • Handsinks available to artists.

  • An artificial light source equivalent to at least 100 foot-candles in the tattooing area.

  • Effective measures against vermin, including self-closing doors, closed windows, or screening of not less than 16 mesh to the inch.

  • Water supply complying with Chapter 64E-8 or 62-550, F.A.C.

  • Sewage disposal complying with Chapter 64E-6 or 62-200, F.A.C.

BODY PIERCING SALONS AND TEMPORARY EVENTS

Body piercing salons are separately regulated under Section 381.0075, Florida Statutes. Temporary tattoo establishments, issued in conjunction with a convention or similar event, are limited to 14 consecutive days and must meet the same operational requirements, including handsinks, under Chapter 64E-28, F.A.C.

COUNTY AND MUNICIPALITY INSPECTION COMMENTS FOR PERMIT APPROVAL

Reviewers and inspectors frequently cite:

  • Floor and wall finishes in the tattooing area not specified as non-absorbent and easily cleanable.

  • No solid floor-to-ceiling separation where the space adjoins living or sleeping quarters.

  • Handsink missing or not conveniently located in the procedure area.

  • Lighting below the 100 foot-candle standard in the tattooing area.

  • Exterior openings not screened or fitted with self-closing doors.

  • Water supply or sewage disposal not documented to the required chapters.
