WHAT THE PROGRAM REGULATES
The program sets sanitation and health standards relating to the construction, operation, and maintenance of migrant labor camps and residential migrant housing. The rule applies to mobile homes, private residential rentals, rooming houses, barracks, and housing authority projects for farmworkers when these facilities constitute a migrant labor camp or residential migrant housing.
STATUTORY AND CODE AUTHORITY (CHAPTER 64E-14)
Authority comes from Sections 381.008 through 381.00897, Florida Statutes, and Chapter 64E-14, Florida Administrative Code. The standards also incorporate federal requirements by reference, and the county health department administers permitting and inspection.
WHEN A PERMIT IS REQUIRED (FORM DH-4082)
A valid permit is required before any person establishes, operates, or allows occupancy of a migrant labor camp or residential migrant housing. Applications are filed with the department 30 days prior to the date of operation on Form DH 4082, Application for a Migrant Labor Camp or Residential Migrant Housing Permit. If an inspection finds the operation conforms to the minimum standards and the fee is paid where required, the department issues the permit.
CONSTRUCTION AND SPACE STANDARDS
All private living quarters constructed, renovated, or used for sleeping shall provide a minimum of 50 square feet for each occupant. In a room where workers cook, live, and sleep, a minimum of 100 square feet per person shall be provided. Sites must be graded and arranged to protect health and safety.
WATER, SEWAGE, AND SOLID WASTE
An approved supply of potable water under pressure meeting Chapters 62-550, 62-555, and 62-560, F.A.C., or Chapter 64E-8, F.A.C., must be available at all times during occupancy for drinking, culinary, bathing, dishwashing, and laundry. Sewage must be plumbed to an approved system, and garbage must be retained in watertight receptacles that protect contents from flies, insects, and rodents.
FEDERAL STANDARDS INCORPORATED (OSHA AND HUD)
Chapter 64E-14 adopts and incorporates by reference the federal Occupational Safety and Health Administration standards for Temporary Labor Camps (29 U.S.C. s. 655) and the U.S. Department of Housing and Urban Development Housing Quality Standards. New or renovated farmworker housing must therefore satisfy state and federal standards together.
COUNTY AND MUNICIPALITY INSPECTION COMMENTS FOR PERMIT APPROVAL
Common comments before a permit is issued include:
Square footage per occupant below the 50 square-foot sleeping or 100 square-foot combined-use minimums.
Potable water supply not documented to the required drinking-water chapters.
Sewage disposal not connected to an approved system.
Garbage storage not in watertight, vermin-resistant receptacles.
Site grading and drainage not adequately addressed.
Application not filed at least 30 days before the intended date of operation.
