WHY THE WETLAND LINE DRIVES YOUR PERMIT

The landward extent of wetlands and other surface waters defines the jurisdiction of the Environmental Resource Permit program. Where the line falls determines how much of a site is regulated, what can be dredged or filled, and how stormwater and mitigation must be designed. Chapter 62-340, F.A.C., adopted under Section 373.421, F.S., provides the method for drawing it.

THE UNIFIED STATEWIDE METHODOLOGY (62-340)

Chapter 62-340 establishes a single, consistent methodology applied throughout Florida, intended to approximate the combined landward extent of wetlands regulated by the water management districts and the Department. The regulating agency first applies the statutory definition of wetlands, with attention to the vegetative communities the rule lists as wetland or non-wetland.

VEGETATION, SOILS, AND HYDROLOGY

The boundary is determined using reasonable scientific judgment to evaluate the dominance of plant species, hydric soils, and other hydrologic evidence of regular and periodic inundation or saturation. The rule sets out the vegetative index of obligate, facultative wet, facultative, and upland plants, the hydrologic indicators, and the wetland hydrology criteria, applied through on-site inspection and aerial photointerpretation with ground truthing.

FORMAL VERSUS INFORMAL DETERMINATIONS

A landowner can obtain a binding Formal Determination of the Landward Extent of Wetlands and Other Surface Waters, which carries a petition fee, or rely on an informal determination for planning. During permitting, the delineation is documented on the Chapter 62-340 Data Form, Form 62-330.201(1), and verified by the reviewing agency.

WHAT THIS MEANS FOR SITE FEASIBILITY

Establishing the wetland line early protects a project's budget and schedule. It tells you the developable footprint, the likely permit path under Chapter 62-330, and whether mitigation will be needed — information that belongs in due diligence, not in a stop-work order after grading has begun.

COUNTY AND MUNICIPALITY INSPECTION COMMENTS FOR PERMIT APPROVAL

Common comments include:

  • Site designed without a confirmed wetland delineation under Chapter 62-340.

  • Delineation not documented on the Chapter 62-340 Data Form for the ERP.

  • Aerial interpretation used without on-site ground truthing.

  • Hydric soil or hydrologic indicators not evaluated where vegetation was disturbed.

  • Mitigation not planned for impacts within the delineated landward extent.
