WHAT THE MANGROVE ACT PROTECTS

The Mangrove Trimming and Preservation Act, Sections 403.9321 through 403.9334, Florida Statutes, regulates the trimming and alteration of mangroves and is overseen by the Department of Environmental Protection. It applies to the three Florida species — red (Rhizophora mangle), black (Avicennia germinans), and white (Laguncularia racemosa) — and the rules do not distinguish between living and dead trees.

THREE PATHS: EXEMPTION, GENERAL PERMIT, INDIVIDUAL PERMIT

The Act establishes three regulatory paths. Limited trimming may be exempt from permitting; somewhat larger work may proceed under a general permit; and alteration beyond those thresholds requires an individual permit. A permit is required for alteration of mangroves under Section 403.9328, F.S., unless an exemption applies.

THE RIPARIAN MANGROVE FRINGE

A key concept is the Riparian Mangrove Fringe, a mangrove area measuring no more than 50 feet from the most landward mangrove trunk to the trunk of the most waterward tree. Trimming within a qualifying fringe is exempt from certain requirements, but trimming to restore historical height or under a general permit still requires a professional, even within the fringe.

PROFESSIONAL MANGROVE TRIMMERS

As the scale of work increases, the law requires the trimming to be performed by a Professional Mangrove Trimmer qualified under Section 403.9329, F.S. — typically an arborist, wetland scientist, or ecologist who meets the statutory experience requirements, including a record of completed, authorized trimming projects.

DELEGATION TO LOCAL GOVERNMENTS

Local governments may be delegated authority to administer mangrove permitting within their jurisdiction, and several South Florida jurisdictions handle these reviews locally. Confirming whether the state or a delegated local program has jurisdiction over your shoreline is the first step before any cutting.

PENALTIES AND RESTORATION

Unauthorized trimming or removal can trigger enforcement, including mandatory restoration of the impacted area for first-time offenses, and both the property owner and anyone performing the work may be held liable. Where strict compliance imposes a unique and unnecessary hardship, Section 403.9333, F.S., allows a variance.

COUNTY AND MUNICIPALITY INSPECTION COMMENTS FOR PERMIT APPROVAL

Common comments include:

  • Trimming or removal performed without confirming exemption, general, or individual permit status.

  • Work beyond fringe allowances done without a Professional Mangrove Trimmer.

  • Jurisdiction not confirmed between DEP and a delegated local program.

  • Dock or seawall work disturbing mangroves without coordinated authorization.

  • Defoliation or removal undertaken as if it were routine trimming.
