Water heater replacement seems like a straightforward project, but Florida law and South Florida jurisdictions require permits for nearly all water heater installations. Unpermitted water heater work surfaces during home sales, insurance claims, and code enforcement inspections.

This guide details when water heater permits are required, the code compliance issues that most frequently fail inspection, and the considerations for tankless and electric heat pump water heater conversions.

WHEN WATER HEATER PERMITS ARE REQUIRED

Water heater permits are required for new installations, replacement of existing units with same fuel type, fuel-type conversions (gas to electric or vice versa), capacity changes (40 gallon to 80 gallon), tankless water heater installations, electric heat pump water heater installations, relocation of existing water heaters, and modifications to gas piping, electrical circuits, or venting. Like-for-like replacement of identical units may proceed without permits in some jurisdictions but always verify locally.

FLORIDA CODE REQUIREMENTS

Florida Plumbing Code and Florida Mechanical Code require water heaters to meet specific compliance points: proper venting for gas units (Category I, II, III, or IV per appliance type), seismic strapping for tank-type units, temperature and pressure relief valve with proper discharge piping, expansion tank in closed systems, drip pan with drain in installations above living space, gas shutoff valve within 6 feet of appliance, and bonding to ground for electric units.

PAN AND DRAIN REQUIREMENTS

Water heaters installed in living areas, attics, or above living space require a drain pan with a drain line discharging to an approved location (typically outside the structure). Drain pan failure or absence is among the most common water heater inspection failures. Pans must be galvanized steel or other approved material, sized 4 inches deep minimum, extend 2 inches beyond the unit footprint, and have a drain line of at least 3/4 inch diameter.

TANKLESS WATER HEATER CONVERSIONS

Converting from tank to tankless water heaters triggers additional permit considerations: typically requires gas line upsizing to support higher BTU demand (tankless units require 150,000-200,000 BTU vs. tank units at 30,000-40,000), 240V electrical service for electric tankless units (typically requires panel upgrade), proper venting for high-efficiency condensing tankless units, additional condensate drain requirements, and water filtration considerations due to mineral content. Tankless conversion permits run higher than tank replacement permits.

ELECTRIC HEAT PUMP WATER HEATERS

Heat pump water heaters (HPWH) require specific installation considerations: minimum 700 cubic feet of conditioned space around the unit for proper heat extraction, ducting to outside air may be required in smaller installation spaces, condensate drain to approved location, electrical service capable of providing 240V circuit, and cold-weather defrost capability (less critical in South Florida). HPWH installations qualify for utility rebates and federal energy efficient home improvement tax credits.

TYPICAL PERMIT COSTS

Water heater permits in Miami-Dade County typically run $150 to $400 for tank replacement, $300 to $750 for tankless conversion. Broward County runs $125 to $350 and $250 to $650 respectively. Palm Beach County runs $175 to $450 and $325 to $800 respectively. Electrical permits for service upgrades supporting electric water heaters add $250 to $500. Gas line modifications add $150 to $400.

APPROVAL TIMELINES

Water heater permits typically process within 1 to 5 business days in Miami-Dade County for standard replacements. Broward County runs 1 to 4 business days. Palm Beach County runs 2 to 7 business days. Same-day permits are available in some jurisdictions through licensed contractor portals. Tankless conversions with gas line modifications take 5 to 14 business days due to additional review.

INSPECTION REQUIREMENTS

Water heater installations require a final inspection covering: proper venting and combustion air for gas units, electrical connections and bonding for electric units, gas piping leak testing for fuel changes, T&P valve and discharge piping, expansion tank if applicable, drain pan and drain line for elevated installations, and seismic strapping. Failed inspections require re-inspection fees and resolution of cited deficiencies.
