Marina, Boatyard and Boat Lift Construction Permits in South Florida 2026

South Florida's 1,200+ miles of inland waterways, canals, bays, and ocean frontage make it one of the world's premier boating destinations. The construction and maintenance of marinas, boatyards, docking facilities, boat lifts, and marine fuel facilities is a specialized construction sector that requires permits from multiple federal, state, and local agencies simultaneously. South Florida's marine construction permit landscape is among the most complex in the United States due to the environmental sensitivity of Biscayne Bay, the New River, the Intracoastal Waterway, Port Everglades, and the Broward and Palm Beach County waterway systems.

Federal Permits for Marine Construction — Army Corps of Engineers

The U.S. Army Corps of Engineers (USACE) has jurisdiction over construction in navigable waters of the United States under Section 10 of the Rivers and Harbors Act of 1899 and Section 404 of the Clean Water Act. Any marina construction, dock installation, dredging, filling, or channel modification in navigable waters requires a USACE permit. Florida Department of Environmental Protection (FDEP) Permits for Marine Work

Mangrove impacts in Miami-Dade County require separate DERM Coastal Construction Permits and FDEP mangrove trimming permits. Unauthorized mangrove removal — even clearing branches that overhang a proposed dock — carries USD civil penalties of up to $50,000 per tree. Local Building Permits for Marine Structures

In addition to federal and state permits, local building permits are required from the applicable county or municipal building department for all structural aspects of marine construction. Dock structures, piers, boat houses, boat lifts, and marine fueling systems are structural improvements that require building permits. Structural engineering plans must be submitted showing the dock framing, pile design, connection hardware, and wind load calculations.
