Lighthouse Point, Lauderdale-by-the-Sea and North Broward Barrier Island Permits 2026

The north Broward County barrier island communities — Lighthouse Point, Lauderdale-by-the-Sea, and Hillsboro Beach — represent some of the most distinctive and environmentally sensitive construction environments in South Florida. Situated on the Atlantic Ocean coast at the Palm Beach County line, these communities combine ultra-desirable waterfront residential development with the most stringent coastal construction permit requirements in Broward County. Each community operates its own building department and enforces environmental standards reflecting their unique coastal character.

City of Lighthouse Point Building Department

Lighthouse Point is a small, prosperous waterfront city between Pompano Beach and Deerfield Beach, known for its extensive canal-front residential development, marina district, and the historic Lighthouse Point Yacht Club. The Lighthouse Point Building Department administers permits for all construction within city limits, including single-family waterfront homes, dock construction, seawall repair, pool installations, and commercial development along Sample Road.

Lighthouse Point enforces FDEP Coastal Construction Control Line (CCCL) permit requirements for construction in the oceanfront CCCL zone, Miami-Dade/Broward HVHZ requirements for all construction, and waterfront setback requirements for canal-front properties. Dock and seawall construction at Lighthouse Point canal-front properties requires USACE, FDEP, and Lighthouse Point building permits simultaneously. USD permit fees follow Lighthouse Point's adopted fee schedule.

The City of Lighthouse Point has active enforcement of its boat and watercraft regulations for dockage areas — boat size limitations, dock setbacks, and waterway clearance standards are enforced as conditions of dock permits. Lighthouse Point residents are active in protecting the navigability and aesthetics of the city's canal system.

Town of Lauderdale-by-the-Sea Building Department

Lauderdale-by-the-Sea (LBTS) is a small, charming beach town between Fort Lauderdale and Pompano Beach that has maintained its character as a pedestrian-friendly, low-rise coastal community despite development pressure. LBTS prohibits building heights above 4 stories in most of the town, preserving ocean views and the small-town character that defines its identity.

The LBTS Building Department administers permits for new construction, renovations, and coastal construction within town limits. FDEP CCCL permits are required for any construction in the oceanfront zone. LBTS has strict flood zone compliance requirements for properties in FEMA Special Flood Hazard Areas, and the substantial improvement rule is rigorously enforced.

Turtle nesting season (May 1 through October 31) imposes special lighting restrictions on construction near the beach in LBTS — artificial lights that illuminate the beach or ocean during nesting hours must be shielded or turned off to prevent disorienting nesting sea turtles and hatchlings. Contractors working on beachfront properties in LBTS during nesting season must comply with these lighting restrictions as a condition of their building permits.

Hillsboro Beach Building Department

Hillsboro Beach is an extremely small barrier island town at the Broward-Palm Beach County line, governed by a town commission and served by a limited building department. Hillsboro Beach has one of the most exclusive residential markets in all of Broward County — oceanfront and Intracoastal-front properties on Hillsboro Beach regularly transact at $5 million USD to $30 million USD or more.

Construction permits in Hillsboro Beach require FDEP CCCL permits for oceanfront work, SFWMD environmental permits for waterfront construction on the Intracoastal side, and standard Broward County HVHZ compliance for all structural construction. The town may use Broward County Building Division services through an Interlocal Agreement for certain building inspection services. Confirm current permit procedures with the Hillsboro Beach Town Hall before submitting any permit application.

FDEP Coastal Construction Control Line Permits for North Broward Barrier Islands

The Coastal Construction Control Line (CCCL) established by the Florida Department of Environmental Protection runs along the Atlantic Ocean coast of all three barrier island towns. Construction seaward of the CCCL requires a FDEP CCCL permit in addition to local building permits. The CCCL permit application requires: detailed construction drawings; a licensed Florida Professional Engineer's certification that the structure is designed to withstand 100-year storm forces; demonstration that the structure will not cause significant adverse impacts to beach and dune systems; and a sea turtle protection plan if construction occurs during nesting season.

FDEP CCCL permit review can take 60 to 120 days. USD FDEP CCCL application fees are based on project type and size. FDEP CCCL permits include conditions restricting construction during nesting season, requiring specific lighting designs, and in some cases requiring post-construction monitoring.

Turtle Nesting Season Construction Restrictions

The Florida Fish and Wildlife Conservation Commission (FWC) and FDEP coordinate with local building departments to enforce sea turtle nesting season construction restrictions along Broward County's Atlantic coast. During nesting season, construction activities on the beach and dune systems may require stop-work orders from sundown to sunup, and artificial lighting must comply with sea turtle-friendly lighting standards. These restrictions apply to projects in all three barrier island communities and apply to all areas of the Broward County Atlantic coast during nesting season.

USD costs associated with sea turtle nesting season construction restrictions — including potential stop-work periods, lighting modifications, and monitoring requirements — must be factored into construction schedules and budgets for oceanfront projects.

Marine Turtle Monitoring Required for Beachfront Construction

FDEP CCCL permits for beachfront construction typically require a certified marine turtle monitoring contractor to monitor the construction site during nesting season (typically May through October, with nest activity through November). The monitor surveys the site before each construction workday for turtle tracks, nests, and hatchlings. If nests are found, FDEP must be notified and work must halt until the turtles are safely relocated or the nesting activity is complete.
