THE CILB AND DBPR
Construction contracting is governed by Chapter 489, Part I, Florida Statutes. The Construction Industry Licensing Board (CILB), housed within the Department of Business and Professional Regulation (DBPR), licenses and disciplines construction contractors, while electrical and alarm system contractors are licensed under Part II by the Electrical Contractors' Licensing Board.
CERTIFIED VS. REGISTERED CONTRACTORS
Florida has historically offered two tiers. A certified contractor passes the state competency examination, holds a certificate of competency issued by DBPR, and may contract anywhere in the state — for example, a Certified General, Building, or Residential contractor. A registered contractor was locally licensed by passing a local competency exam and was limited to the jurisdiction that granted that competency.
WHEN A LICENSE IS REQUIRED
Under Section 489.103, F.S., a contractor license is required for construction work valued at more than $2,500; work below that threshold must still be casual, minor, and inconsequential in nature. The state recognizes more than thirty-five distinct license categories across general, building, residential, and specialty trades.
THE 2021-2025 LOCAL LICENSING PREEMPTION
House Bill 735, effective July 1, 2021, preempted local licensing: a county or municipality may not require a license for a job scope that does not substantially correspond to a state contractor or specialty category. House Bill 1383 (2023) directed the CILB to create certified specialty categories for voluntary licensure, and most pre-existing local specialty licenses sunset by June 30, 2025, with state preemption taking full effect July 1, 2025. The result is a licensing system centralized under DBPR and the CILB.
UNLICENSED CONTRACTING PENALTIES
Unlicensed contracting carries real consequences under Section 489.127, F.S., including civil fines up to $10,000 and criminal penalties that escalate when work is performed during a declared state of emergency. An owner who hires an unlicensed contractor also has limited legal recourse if the work goes wrong.
VERIFYING A LICENSE
Before signing a contract, an owner should verify a contractor's license category and status through the DBPR public license verification system. A certified license is tied to a qualifying agent who is responsible for the contracting activities of the business, and the category must match the scope of the work.
COUNTY AND MUNICIPALITY INSPECTION COMMENTS FOR PERMIT APPROVAL
Common comments include:
Permit applied for by an unlicensed contractor or one in the wrong category.
Scope of work exceeding the contractor's license category.
Reliance on a local specialty license that sunset after July 1, 2025.
Qualifying agent not properly tied to the contracting business.
Owner-builder permit used to circumvent the licensing requirement.
